At the end of May 2008 the five countries bordering on the Arctic - Denmark, Canada, Norway, the Russian Federation and the United States of America (known as the 'A5') - adopted a carefully-worded declaration. Known as the Ilulissat Declaration after the place in Greenland where the conference was held, it outlines the kind of co-operation the A5 is considering. From the text one can also glean what principles will be applied regarding legal arrangements, research, managing natural resources and the ecosystem of the Arctic Ocean. In the declaration the A5 emphasise their supremacy in this area. They speak in favour of applying the international law of the sea to the Arctic but against the conclusion of a specific Arctic agreement. This sends an important signal to other potential Arctic players and to the international community, and is therefore also of interest to Germany, which for environmental, research and economic reasons cannot be indifferent to the Arctic region
Die fünf Arktis-Anrainerstaaten Dänemark, Kanada, Norwegen, Russische Föderation und Vereinigte Staaten von Amerika (»A5«) haben Ende Mai 2008 eine - sorgfältig redigierte - Erklärung verabschiedet. Die nach dem grönländischen Konferenzort benannte »Erklärung von Ilulissat« steckt den Rahmen für die ins Auge gefasste Kooperation der A5 ab. Man kann aus ihr auch künftige Spielregeln für Rechtsordnung, Forschung, den Umgang mit Ressourcen und mit dem Ökosystem des Arktischen Ozeans ablesen. Die A5 betonen mit der Erklärung ihre Vorrangstellung in diesem Raum. Sie sprechen sich für die Geltung des Seevölkerrechts in der Arktis, zugleich aber gegen einen spezifischen Arktisvertrag aus. Dies ist ein wichtiges Signal für weitere mögliche Arktis-Spieler und die internationale Gemeinschaft und ist daher auch für die Bundesrepublik von Interesse, der aus Umwelt-, Forschungs- und Wirtschaftsgründen der arktische Raum nicht gleichgültig sein kann
Das vorliegende Beiheft beinhaltet die deutschen Landesberichte zu den Themen des XXIII. Kongresses der Internationalen Föderation für Europarecht (F.I.D.E.). Sie behandeln die Themen "Vorbereitung der Europäischen Union auf die Zukunft? – Notwendige Änderungen des Primärrechts nach der Nicht-Ratifizierung des Vertrags über eine Verfassung für Europa", "Die Modernisierung des EG-Kartellrechts – Erste Erfahrungen mit der VO 1/2003" und "Die Dienstleistungsrichtlinie und ihre Umsetzung in Deutschland". Die Berichte beziehen sich im Einklang mit der Methode des F.I.D.E.-Kongresses jeweils auf einen Fragenrahmen, der von dem thematisch zuständigen Generalberichterstatter entworfen wurde
